This program is presented by a panel consisting of an Appellate Division Justice and experienced practitioners who are or have been members of the Committee on Character & Fitness or the Grievance Committee, and a defense lawyer who represents lawyers and judges.

Artificial intelligence is rapidly becoming a part of our practices in many ways. Trial lawyers must grapple with the ethical challenges AI presents. We will focus on how AI tools are shaping advocacy and trial practice—and what ethical standards guide their use. We will review legal standards, new rules, and the ethical pitfalls of using AI-generated evidence or arguments in court proceedings. Additionally, we will discuss the rules relating to confidentiality once AI systems are engaged, as well as the rapidly developing rules regarding the disclosure of AI use in court proceedings. While AI presents challenges, an attorney’s obligation to practice with competence (their own, not artificial) can never be substituted – or can it?

This CLE will also include an explanation of what AI is, how it works, and how it’s already reshaping legal practice. Understanding AI's impact on legal practice is not just important, it's crucial. There will also be an explanation of key types of AI—LLMs, agents, media generators, and how each one affects your cases, clients, and strategies. You will learn how AI can fabricate evidence, create deepfakes, or cause cybersecurity risks. You will also learn how lawyers can safely deploy AI tools while preserving client privacy and staying compliant. The CLE includes how LLMs process language, their strengths and weaknesses, and how to maximize their capabilities.
